A last-minute scramble preserved two Republican House seats in Florida, even as the GOP lost an epic battle for a Wisconsin Supreme Court slot. Democrats are stretching to claim their Badger State win represents a rejection of the Trump agenda; that’s overkill. But the GOP loss in Wisconsin—and the party’s struggle in Florida—underline that Trump’s popularity is no sure thing and Republicans will have to show results, think strategically, and put as much effort into elections going forward as they did in November. Trump’s Sunshine poach: The Florida stakes were huge—and entirely of Trump’s making. The president spent four years at Mar-a-Lago, becoming more enmeshed in the state political establishment, then tapping more than a dozen Florida-connected politicians for top jobs—including Chief of Staff Susie Wiles, Attorney General Pam Bondi, and Secretary of State Marco Rubio. More problematically: While Speaker Mike Johnson pleaded with Trump not to poach from his tiny majority, the president chose to nab former Florida Reps. Mike Waltz and Matt Gaetz for key positions—setting up Tuesday’s races. Trump’s Gaetz pick was particularly counterproductive, opening a House seat even as Gaetz failed to win Senate support as Trump’s first AG pick. Trump tacitly acknowledged his House plunder mistake when he recently withdrew New York Rep. Elise Stefanik for United Nations ambassador, admitting the problems of a “tight Majority.” Races? What races?: Having provoked these contests, the national party then largely ignored the special elections in Florida Districts 6 and 1, trusting that any GOP candidate would cruise to victory in two districts Trump won by more than 30 points last year. Yet modern history shows Democrats excel in special elections, and the GOP got a wakeup call last month when Democrat Josh Weil in District 6 outraised Trump’s handpicked candidate— state Sen. Randy Fine—10-1. Democrat Gay Valimont similarly outraised and outspent Republican Jimmy Patronis in Florida 1. The lack of attention was stunning, given Johnson’s minuscule majority. Florida cleanup: A last-minute push shored up the Republican candidates, with both winning about 57% of the vote. But that’s a big step down from Waltz’s 33 point victory, or Gaetz’s 32 point win, in 2024. Democrats poured a ton into these races, intent on using them to suggest national disaffection with the Trump agenda—and came up short. But Republicans showed a level of disarray that suggests way too much smugness. Wisconsin battleground: The Wisconsin court loss ought to smart more. The race also held huge implications. Susan Crawford’s win maintains a liberal majority on the court, with issues at stake ranging from abortion rules to collective bargaining rights to school choice to redistricting maps. Democrats worked for months to nationalize the race, gin up turnout and present a win as a referendum on Trump’s and Elon Musk’s initial federal efforts. They won that bragging right. Outmatched: Conservative activists worried for weeks that the GOP also wasn’t fully engaged in Wisconsin. While Musk ultimately poured real money into backing conservative Judge Brad Schimel, and while he (and other big Republicans names) visited toward the end, that end-game work didn’t match the sustained Democratic effort. Turnout was high, especially in blue and suburban counties.

Republicans capitalized last fall on a turnout operation that targeted low-propensity voters, but one Tuesday lesson is that those voters can’t necessarily be counted on to show up in lower-profile contests. Wisconsin awarded Trump his narrowest majority of all the swing states last November. The results weren’t the clear message Democrats claim. Note that even as Schimel lost, Wisconsin voters handily approved an amendment to the state constitution requiring photo ID to vote. But the results should nonetheless have Republicans biting their fingernails. They were a blunt reminder that Trump’s “mandate” is only as enduring as voters’ good will. The president is straining that relationship with a fickle tariff policy and slow legislative agenda. The GOP as a whole is going to have to prove it can govern and work hard to keep connecting with voters. A tax reconciliation bill anyone? Congress? Defunding the Judiciary A flood of judge-issued national injunctions against Trump policies continue to inspire a counterflood of Republican proposals to rein in judges. That includes a brand new suggestion from House Judiciary Chair Jim Jordan: Cut off federal dollars. In a Monday letter to House Appropriations Chair Tom Cole, Jordan urges the committee to use “the power of the purse” to “enhance judicial restraint and reaffirm democratic principles.” Specifically, he suggests appropriations language “prohibiting the use of taxpayer dollars and federal resources to issue or enforce these overbroad injunctions beyond the specific parties in front of an issuing court,” backed by a more specific bar on any funds that would be used to “compel compliance, impose fines, or conduct contempt proceedings related to such injunctions.” The letter simultaneously urges the appropriations committee to “appropriately fund judicial security measures to protect justices, judges, court employees.” The Jordan proposal comes amid a broader GOP push for legislation to curb “judicial policymaking.” The House Rules Committee voted on Tuesday to advance Rep. Darrell Issa’s “No Rogue Rulings Act”—which would limit district court judges’ ability to issue universal injunctions—while both Sens. Chuck Grassley and Josh Hawley have introduced Senate versions of the same. Don’t say it out loud, but one benefit of these proposals is to allow Republicans to walk back Trump and Musk calls to outright impeach justices—moves that excite a portion of the base, but that GOP leaders rightly worry are problematic on both principled and political grounds. The efforts also raise pressure on the Supreme Court to handle the issue itself, by providing guidance to lower courts on the use of injunctions. This would be the cleanest solution— and is long overdue. DOJ Drops ‘Jim Crow 2.0’ President Joe Biden proved a gaslighting pro, a perfect example was his claim that any GOP state effort to secure elections amounted to “racist” efforts to suppress minority voters. Trump Attorney General Pam Bondi has now ended one of the worst formalizations of that distortion, a Justice Department lawsuit against Georgia’s 2021 election overhaul. Biden instantly derided Georgia’s overhaul as “Jim Crow in the 21st century,” nevermind the law’s straightforward provisions—which left in place no-excuses absentee voting, expanded weekend early voting and replaced messy signature matching procedures with a requirement that voters instead supply a state ID number. Georgia has consistently clocked new turnout records under the law, including for black voters, and a Journal editorial noted that a University of Georgia survey found that 73% of black voters called their 2022 voting experience “excellent,” while another 24% said it was “good.” Yet Biden’s rhetoric had real economic consequences, including Major League Baseball’s decision to yank its 2021 All-Star Game from Atlanta in protest of the law.
