Defense Secretary Pete Hegseth on Wednesday announced a "ruthless" overhaul of the military’s legal offices. “For too long, over 20 years, legal shops across the services have grown bloated, duplicative, they've muddied lines of authority and pulled critical judge advocates away from what matters most — advising commanders in the fight on operations in deployed environments where seconds and minutes count,” Hegseth said in a video posted to social media. He said he had directed the service secretaries, through their general counsels, judge advocate generals (JAGs) and the staff judge advocate to the commandant “to execute a ruthless, no-excuses review." “Scrub it clean, cut duplication and bureaucracy, clarify roles and reporting. No more moral ambiguity," according to Hegseth. He characterized the changes as a remedy to military lawyers sometimes being stuck doing civilian side work. “That drains readiness and leaves gaps where we can't afford to have them,” he said. The push to reorder the “current allocation of legal resources and functions” of the Defense Department’s uniformed and civilian lawyers comes amid the U.S. and Israel's war with Iran and ongoing strikes on suspected drug smuggling boats in the Caribbean — both of which have been decried as illegal operations by Democrat lawmakers and some legal experts. The United States also has reportedly been found responsible for a deadly Feb. 28 Tomahawk missile strike on an all-girls Iranian elementary school due to a targeting error by the U.S. military. The strike killed at least 175 people, most of them children. The investigation is ongoing. Hegseth’s directive also follows a little more than a year after he fired the top lawyers for the Army, Navy, and Air Force, claiming they were potential “roadblocks to orders” given by President Trump. The JAGs’ official duty is to provide independent legal guidance to senior military officers in the Pentagon and on battlefields to avoid potential legal issues with U.S. or international laws surrounding armed conflict. But the recent changes have raised concerns that Hegseth is gutting legal oversight of the administration’s actions, reducing accountability by seeking to cut those seen as disloyal to the president or his agenda and by separating the duties for uniformed and civilian lawyers within the Pentagon — reducing civilian oversight in times of conflict. “In a great power competition or with any threat that we face, commanders need agile, independent, dead-on legal advice that enables decisive action, not endless process or turf wars,” Hegseth said. “They need JAGs focused on war fighting, military justice, operational law, law of armed conflict, deployed contracting, Intel law, cyberspace, you name it, everything that sharpens the edge in large scale combat.” Civilian general counsels, meanwhile, would take on “non-operational stuff” including acquisitions, civilian personnel, intellectual property, real estate, patents, and litigation outside of military channels, among other areas, he said. He added that there would be “limited shared areas” between the two sides including standards of conduct or FOIA and privacy, “if it makes sense for the services.” Hegseth has set a deadline of 45 days for reports on any overlap between the service’s military and civilian legal departments to the Defense Department's General Counsel, with full changes expected within six months. Hegseth’s message on Wednesday was at odds with his actions as Pentagon chief, as he has on multiple occasions approved sending uniformed lawyers to aid in civilian matters. In August, the Pentagon approved the transfer of up to 600 of its military and civilian lawyers to the Justice Department to serve as temporary immigration judges. The decision funneled Defense Department lawyers to help deal with a backlog of Department of Justice cases by presiding over immigration hearings, a far cry from advising commanders. That same month, 20 members of the JAG Corps were detailed to the U.S. Attorney’s Office in D.C. to work alongside federal prosecutors taking on civilian cases in the nation’s capital. Then in October, Hegseth ordered the military to provide 48 lawyers to the Department of Justice for temporary assignments in Memphis and near the U.S.-Mexico border. It was an unusual role for JAGs, who typically represent the armed forces in carrying out prosecutions, acting as defense attorneys or offering legal advice to service members.
